New Danger for Immigrants and visa holders applying for Unemployment

While the official policy of New York State respects the privacy of unemployment applicants, we have received numerous reports of individuals posing as "unemployment officials" contacting non-citizen applicants. These impostors request in-person meetings for an "interview" and persistently follow up to ensure attendance. In all known instances, when claimants contacted the Department of Labor (DOL) directly, they were informed that no such interviews had been scheduled.


Reports have come from Permanent Residents, DACA recipients, refugees, and HB-1 visa holders, with salaries ranging from minimum wage to over $500,000 annually. Given the current circumstances, even citizens should exercise caution to avoid potential abductions. The disarray within immigration services has led to the arrest of citizens and the deportation of others without proper hearings. Attending a dubious "unemployment interview" could result in dire consequences, such as being stranded in a conflict zone, relying on friends and family for assistance in returning to the United States.

Applicants are advised to consult with an attorney before agreeing to any in-person meetings regarding unemployment "interviews" to safeguard their rights and preserve their ability to appeal any adverse decisions.


Why is this occurring? Although it is difficult to ascertain the exact reasons, it is plausible that certain discontented DOL employees may be clandestinely providing immigrant applications and unemployment files to ICE officials to facilitate discreet arrests of legal workers. Motivations may include political agendas or envy of high salaries.

Therefore, all claimants should exercise heightened caution when responding to such requests.
