Protect Your Right to Unemployment Benefits in New York

If you’ve lost your job through no fault of your own, you have the right to unemployment benefits. But winning those benefits—especially when an employer challenges your claim—isn’t automatic. That’s where we come in.

At Unemployment Win!, we represent workers at unemployment hearings and appeals throughout New York State, including New York City, Long Island, and all upstate hearing locations.

We are vigorous, experienced representatives—and we don’t get paid unless you win!

Why Representation Matters

New York State data shows that nearly 90% of claimants attend hearings without representation. That’s a big risk. According to a Brennan Center study, represented claimants were twice as likely to win their hearings. (click here for report)

Meanwhile, employer representation has become a booming industry, as noted by the New York Times (New York Times, 4/3/2010,  click here for article). Most employers now send trained reps to fight your claim. These reps appear in case after case and often develop close working relationships with hearing judges. Some have even been known to use improper tactics that put unrepresented claimants at a serious disadvantage.

You shouldn’t walk into that hearing alone.

No Fee Unless You Win

At Unemployment Win!, we only get paid if you win. You never pay more than what you gain in benefits.

Compare that to many attorneys in New York, who charge $350–$1,000 per hour—or, in some extreme cases, $4,000 up front for a single hearing. That’s not how we do things. We make expert representation affordable for everyone.

What We Do for You

If we accept your case, we will:

  • Represent you at your unemployment hearing before the judge

  • Handle both in-person and virtual hearings

  • Prepare your case in advance

  • Appeal if the judge rules against you and there are valid grounds

  • Fight back against employer tactics and witness credibility issues

We expect to win if we take your case—and we prepare like it.

When to Contact Us

Do not wait until you receive a hearing date to reach out. Hearings are often scheduled with only 1–2 weeks’ notice, and delays can lead to defaults that can be hard (or impossible) to reopen.

Contact us as soon as:

  • You receive a denial from the Department of Labor, or

  • You find out your employer has appealed your approval

Early contact gives us the time we need to properly review and prepare your case—and increases your chances of success.

Frequently Asked Questions

Can I win without a representative?

You can—but your odds are significantly lower. Employer reps know the system, and they play to win. So should you.

What does it cost?

There’s no fee unless you win. Our low hourly rates are capped so you’ll never pay more than your total benefits. Learn more about our fee structure here »

Will someone be with me at the hearing?

Yes. If you retain us, a representative will attend the hearing with you and speak on your behalf. We attend both virtual and in-person hearings.

Another lawyer said I didn’t have a case. Can you still help?

Maybe. We conduct our own independent review. We’ve won many cases that were turned down by others. If, on the other hand, we don’t take your case, keep looking—you deserve to be heard.

What to Look for in a Representative

  • Experience before the Unemployment Insurance Appeal Board

  • A track record of winning decisions

  • Someone who will prepare your case in advance, not just show up and trust to luck!

  • A representative who doesn’t take multiple cases on the same day just hoping one will win

  • No upfront fees—only escrow or contingency payment

At CMH Services, we fight smart, prepare thoroughly, and stay with you through appeal if necessary.
